STEPS TO GETTING A DIVORCE IN TRINIDAD AND TOBAGO

Here are the Steps to getting a Divorce in Trinidad and Tobago. The law under the Matrimonial Proceedings and Property Act Chap 45:51.

Section 5 (1) a divorce petition cannot be presented until one year of marriage has passed unless there are extreme circumstances.

Section 3

The marriage must be at a stage where reconciliation is impossible.

Section 4(1)

The person initiating the divorce must prove:

(a) the respondent has committed adultery and the petitioner finds it intolerable to live with the respondent;

(b) the respondent has behaved in a way that the petitioner cannot reasonably be expected to live with the respondent;

(c) the respondent has deserted the petitioner for a continuous period of at least two years immediately preceding the presentation of the petition;

(d) the parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of the petition and the respondent consents to a decree being granted;

(e) the parties to the marriage have lived apart for a continuous period of at least five years immediately preceding the presentation of the petition.

Section 4(2) – Empowers the court to investigate

Section 24(1) – A spouse may be entitled to maintenance especially when the other decides to leave his/her partner in a position that may impose a burden on society (benefits, etc.). E.g. disability or children. A most recent case at the time of posting: Ann-Marie Ramdhan v Peter Ramcharan, delivered on 22/06/2010. If one spouse is overseas, Sections 62 – 62H lays down the law in that regard.

        i have been married a year now and i am still unhappy in my marriage i felt this way before marriage but this was because i taught my husband would change and no longer allow his sister and mother to control him things just got worst my husband has no time for me i feel as if i am not being heard by him i want to start my own family but he is to busy taking care of his mother and sister that he never have time for us..i tell him this every time i feel this way but he just things that i am joking i feel as if i am lost i have no independence each and everything i have to ask him for he does not want me to work i cant have my own bank account he wants it to be joint with his …i feel trapped what can i do??

    Hi….I have been separated for 3 years now an i have moved on an i haven’t seen or talked to my legally married husband which is my child father an he doesn’t pay any mantainance since he was order to pay…so right now he has warrants out for him an don’t no where he is or have a contact number for him….so I would like to no if I would still be able to get a divorce and how long will this procedure take..

    My aunt married in Muslim about 33 years ago here in Trinidad! They now live in Montreal Canada & she has been living through verbal abuse for over 10 years, she is however fed up but she does not know the process to start applying for the divorce!     Hi. My husband and I have been together for 7 years. We got married last December and two months ago he told me to leave during an argument we had. I am now back at my parents home. We’ve had arguments every now and then because he is addicted to marijuana. He doesn’t want to compromise with me on this matter, get help or do marriage counseling together.     I want to file for divorce because my wife and I was separated for the past 3 years.. I have proof of her committing adultery and other evidence.. we have a 3 year old daughter that I “the father”, took care of her and maintained since she was a year and a half old (1 1/2). My daughter is currently 5 years at the moment and is enrolled in school.. If I file for divorce will the courts grant my wife custody of my child??     After the divorce hearing with the magistrate or judge, they normally state that once approved you have to wait 2-3 months for the final divorce decree or papers. During this time can the divorce be reversed before receiving the final papers?

    Good day, My husband is a Police officer (SRP), he has a fire arm and a uses License, He threatens to kill me and his self several times, he is constantly verbally abusive and caught in several situation of infidelity, the most recent situation he was video recorded checking into the Hilton Hotel with another female, i visited the Hilton the night just to let him know that i am aware, that he is not on work as he claimed. He is bringing this other female in our home in my absence and removing any sign of existence in the home while she there, going as far as saying to the other female that he already divorced. we recently purchased a home and a new vehicle and we have a child together and i take care of his daughter from another relationship. Please, help i am in a state of bewilderment.
