RIGHTS OF EMPLOYEES IN TRINIDAD & TOBAGO

Workers in Trinidad and Tobago enjoy many legal rights. In this week’s article we look at some of these rights
Minimum wage
The Minimum Wages Act Chap. 88:04 provides for a national minimum wage for all workers generally. This minimum wage was recently increased, effective January 2015, to $15 per hour. Employees can report non-compliance by their employer to their trade union or the Minister of Labour.
Health and safety
Workers have often downed tools in dissatisfaction with workplace conditions. Under the Occupational Health and Safety Act Chap. 88:08 employers must provide a safe and healthy work environment, protective clothing and equipment at no extra cost, and adequate training and supervision. Employees can refuse to work in unsafe environments. The Act covers both public sector and private sector employees.
Injury at work
When injuries occur at work because of an employer’s wrongful or negligent act the Workmen’s Compensation Act Chap. 88:05 provides for jured on the job to make a claim – section 4. Where death results from the injury a dependant of the deceased may also bring a claim – section 9. Funeral expenses may also be recovered.
National Insurance
The national insurance system provides employed persons with many benefits including assistance with maternity, sickness, funeral grants, survivorship, invalidity and employment injury. A worker paid more than $180 per week must register and contribute to NIS. Employers who do not pay contributions for their employees will be liable under the National Insurance Act Chap. 32:01.
Leave
Vacation leave with pay is a right. Paid sick leave, normally 14 days per year, is also a right. Under the Maternity Act Chap. 45:57 a woman is entitled to 13 weeks paid leave and to return to work in a position no less favourable than that she left. If her baby died before she left for maternity leave or in childbirth, she is still entitled to the rest of her maternity leave. A non-unionised employee alleging non-compliance has recourse to the Minister of Labour.
Paternity leave is not mandatory by law but some institutions have made it a part of their regulations. Male teachers, for example, are permitted four days leave around the time their partner or spouse is about to deliver.
Non-discrimination
The Constitution guarantees citizens equal treatment from public authorities. The Equal Opportunity Act Chap. 22:03 adds another layer of protection for all workers against discrimination in the workplace. An employer cannot refuse employment or discriminate against employed persons on grounds of sex, race, ethnicity, origin, marital status, religion or disability. The Act does not, however, cover discrimination on the basis of sexual orientation. Employees alleging a breach may bring a complaint to the Equal Opportunity Commission.
Dismissal
A worker is entitled to severance pay if he is dismissed from employment in certain circumstances. Where an employee claims to have been wrongfully or unfairly dismissed, ultimate resort may be had either to the Industrial Court or High Court.

    i need yours urgent assistance or information in respect to vacation leave. entitlement for an employee working an continuous period after 1 year isn’t 14 working days with pay or 2 weeks

    Good day, I have been working for a private company for over 30 years and I am sick with health issues, I was paid more than minimum wage and sometimes I was paying nis, but now I am sick and cannot work like before, I never signed a contract seeing as I cannot read or write, so I’m not sure of what compensation I can get, I have to leave because I am sick and cannot work anymore, is there anything I can get from the company.

    My employer just informed me of reduction of my two days off per month to one day if there is public holiday in a particular month.For example,month of June where two holidays exist he said I have only one day off.Being working with the company for the past 5 years.Out of the blue he just told me that 2nd of June 2018.Please kindly help and advice.

    Good Day

    I am currently employed for the last 2 years by the same company and i work Monday to Saturday, I am applying for 8 days vacation which one of the days fall on a Sunday. Do i check the Sunday as a vacation day or not?

    On Thursday 18th October, 2018 I could not come to work due to the excessive rain and flooding in my area. I am now being told that I have to apply for the day even though I explain to my supervisor that I really wanted to come to work but the road was impassable. Is there something call rain leave in the Industrial Relations Act/Labour Laws of Trinidad and Tobago?

    Need to know, if as a monthly paid worker, with a contract that says Mon-Fri, but also work on a Saturday if I am entitled to time and a 1/2 for Saturdays as it would be over 40 hrs for the week.
    And if I’m supposed to give back time for holidays.

    Hi good day I was fired by a company that I signed a contract without having a y prior conduct warning or issues. I was fired on my first offence which was not even means for termination. Myself and a other worker was performing a task given to us while doing so we needed to get to the other end of the tape so we ducked under and finished out task. 3 days later we was told that we broke safety and we are no longer working and would not be considered for future jobs at the company. Can I build a case against them. Thanks.

    Good day, I am a proud father of 3 children but can’t seem to get paternity leave or vacation for the birth of my last child from my employer. My child was born through cesarian and my presence is greatly required at home.. how can I go about securing paternity leave or vacation leave seeing as I have already completed 1 year’s service

    Can i get some feedback concerning working on public holidays.
    I work in the privite sector employed for thirteen yrs.
    Every year public holidays come I have to go through this challenge .
    What exactly is the salary or time to be given back. My contract did not state anything about public Holidays working.

    Call my employer today to get a letter to apply for nis help to find out I am not employed by the company since December 2019 and his reason is because I have another work in the day which BTW was agreed upon by my employer or x employer that I would be working evenings with him alone and I only starred working the other work in the day only from march 2020 so I was not working and his was not being paid and there is no law saying that I can’t work 2 jobs it has more to thus story but I need help in this matter he is claiming that I have another job so I can’t work for him and so he does not yav to pay my nis also but in the NIBTT document clearly stated that it can be done and was established on march 1 2014 help me deal with this unfair employer please
